Prive — Terms of Service

These Terms of Service ("Terms") govern your use of the Prive mobile application ("Prive", "the app"), a private photo and video vault developed and operated by Vinh Dang ("the developer", "we", "us"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. License to Use

Subject to these Terms, the developer grants you a personal, non-exclusive, non-transferable, revocable license to use Prive on Apple devices that you own or control, in accordance with the Apple Media Services Terms and the App Store guidelines.

2. Your Responsibilities

• You are responsible for remembering your PIN and album passwords, and for saving your 24-word Recovery Key — it is the only way to reset a forgotten PIN.
• You are responsible for maintaining backups. While Prive offers optional iCloud sync, you remain responsible for the safety and availability of your data.
• You agree to use the app only for lawful purposes and only with content you have the right to store.
• You must keep your device and Apple ID secure, as access to either may affect access to your vault.

3. Acceptable Use

You agree not to use Prive to store, or to use the app for, any content or activity that:

• Is illegal under the laws that apply to you;
• Involves child sexual abuse material (CSAM) or any exploitation of minors;
• Infringes the intellectual property or privacy rights of others.

Because the app is fully private and we cannot see your content, enforcement of this section relies on you. Storing unlawful content is solely your responsibility and may be a crime in your jurisdiction.

4. Subscriptions & Purchases

Prive is currently offered free of charge with its full feature set. In the future, the developer may introduce optional premium subscriptions. If and when that happens:

• Pricing and terms will be clearly disclosed in the app before any purchase.
• Purchases and subscriptions are processed by Apple through the App Store and are subject to the Apple Media Services Terms.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings.

5. Privacy

Your use of Prive is also governed by our Privacy Policy, which explains how the app handles information. In short: we do not collect your data.

6. Disclaimer of Warranties

Prive is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost. You use the app at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of (or inability to use) Prive. This includes, without limitation, loss of access to your content due to a forgotten PIN, loss of your iCloud Keychain, device loss, or data corruption. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim, if any.

8. Changes to the App and Terms

We may modify, suspend, or discontinue features of Prive at any time. We may also update these Terms from time to time; the "Last updated" date will reflect any changes. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

9. Termination

You may stop using Prive at any time by deleting the app. We may terminate or suspend your license if you materially breach these Terms.
